LDE trial lawyers Jim Lynch and Eric Zisk obtained a defense verdict for their client Design Within Reach (DWR) after a two week trial in Kings County (Brooklyn) Supreme Court. Both the plaintiff and the co-defendant claimed that a chair sold by DWR was defectively manufactured. The jury unanimously rejected that claim and found that the chair was not defective. Rather, the jury found codefendant EQR-180 Riverside H, LLC (EQR) one hundred percent responsible for plaintiff’s accident. EQR was the owner of the building where the accident happened. The jury found that the subject chair was in an unsafe condition while in EQR’s possession, EQR was negligent, and that EQR’s negligence was the sole cause of plaintiff’s accident.
