On June 14, 2023, the Honorable Alexandra P. Murphy of the Westchester County Supreme Court granted our client’s motion for summary judgment in an asbestos-personal-injury case. The plaintiff alleged that he developed mesothelioma from exposure to asbestos from, among other sources, a number of our client’s products. To defend the case, LDE obtained evidence that demonstrated that none of the client’s products at issue contained asbestos. Plaintiff’s counsel, a very successful mass tort firm, attempted to defeat the motion by arguing that there was evidence that these products did contain asbestos. But, on reply, LDE was able to demonstrate that the plaintiff’s arguments were speculative and that the evidence showed that our clients’ products could not have caused the plaintiff’s mesothelioma. The Court agreed, and all claims against our client were dismissed.
